Notwithstanding anything to the contrary present in the solar roof lease agreement, the Lesse shall be allowed to access the premises twenty four hours a day, seven days a week for emergency purposes, as determined by the lesse in the agreement.
In case of such emergency situations, the Lesse is entitled to give a written explanation to the landlord. As per the solar roof lease agreement, all these emergency work shall be prosecuted to completion but such work shall not remain in an unfinished condition.

The Landlord is also provisioned to appoint an agent for the lesse. Also, by way of the Solar Roof Lease Agreement, the landlord acknowledges the fact that, he has no ownership in the generating facility and hence the property cannot be leased, sold, mortgaged or leased by the landlord.
From here on, the Lesse shall be solely responsible for the operation and maintenance of the generating facility. In commercial operation, the generating facility is targeted to have a combined generation capacity.

Moreover, if the generating facility must be moved to, or replaced at an alternate location , it is subject to the approval of both, the power provider and the purchaser.
Added to it, the purchaser is entirely responsible for the temporary removal of the generating facility. But, notwithstanding the Generating Facility’s presence as a fixture on the Site, Purchaser is not entitled to allow outside interference with the generating facility’s isolation and access to sunlight.
But, the Landlord is provided with the option of adding on additional power generation equipment to the existing generating facility. By accepting this Solar Roof Lease agreement, both the parties also agrees to co-operate for the proper functionality of the generating facility.
